1. Agreement to Terms

By accessing or using Wave Chat ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Important: These Terms constitute a legally binding agreement between you and Wave Chat. Please read them carefully.

2. Account Requirements

To use Wave Chat, you must:

• Have an Instagram Business Account or Facebook Page connected to Messenger
• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with Meta's (Facebook/Instagram) Platform Terms and Policies

You are responsible for all activities that occur under your account.

3. Subscription & Pricing

3.2 Payment Terms

• Payments are processed securely through Stripe
• Subscriptions renew automatically unless cancelled
• Monthly plans bill every 30 days, yearly plans every 365 days
• No refunds: All payments are final and non-refundable
• You may cancel your subscription at any time (access continues until period end)

3.3 Rate Limits

If you exceed your plan's message limit, the chatbot will stop responding until the next hour. No overage charges apply.

4. Service Availability

Wave Chat is provided on an "as-is" and "as-available" basis. We do not guarantee:

• Uninterrupted or error-free operation
• Specific uptime percentages
• That the service will meet your requirements
• That chatbot responses will always work as expected

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

5. Acceptable Use

You agree NOT to use Wave Chat for:

• Illegal activities or prohibited content
• Spam, harassment, or unsolicited messages
• Impersonation or fraudulent activity
• Content that violates Meta's Platform Policies
• Malware, viruses, or harmful code
• Circumventing rate limits or system restrictions

Violation of these terms may result in immediate account termination without refund.

6. OAuth & Platform Connections

By connecting your Instagram or Facebook account:

• You authorize Wave Chat to access your account via Meta's OAuth API
• You must maintain a valid OAuth connection (tokens expire every 60 days)
• You can revoke access at any time through your Meta account settings
• Wave Chat is not responsible for changes to Meta's API or policies

7. Intellectual Property

7.1 Your Content

You retain all rights to the chatbot messages and content you create. You grant Wave Chat a license to store and process your content to provide the Service.

7.2 Our Platform

Wave Chat's platform, design, code, and branding are owned by us and protected by copyright. You may not copy, modify, or distribute our platform without permission.

8. Limitation of Liability

To the maximum extent permitted by law:

• Wave Chat is not liable for any indirect, incidental, or consequential damages
• We are not responsible if your chatbot malfunctions or fails to respond
• Our total liability is limited to the amount you paid in the last 12 months
• We are not liable for losses caused by Meta API changes or outages

Some jurisdictions do not allow liability limitations, so these may not apply to you.

9. Account Termination

9.1 By You

You may delete your account at any time through the Settings page. Your data will be deleted immediately upon request.

9.2 By Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the platform or harm other users

Termination does not entitle you to a refund.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of significant changes via email.

11. Governing Law

These Terms are governed by the laws of Portugal. Any disputes will be resolved in the courts of Portugal.
